Whereas, the Government of India passed the Real Estate (Regulation and Development) Act 2016 (the Act), and all of its parts became operative on May 1, 2017. And for these reasons, the Maharashtra Real Estate Regulatory Authority, often known as "MahaRERA'' or "the Authority," was founded by the Maharashtra government by Notification No. 23 dated March 8, 2017. And in view of the fact that the Maharashtra government has published the Maharashtra Real Estate (Regulation and Development) (Registration of Real Estate Projects, Registration of Real Estate Agents, Rates of Interest and Disclosures on Website) Rules, 2017 (the Rules) in order to implement the Act's provisions. And in light of the fact that the Authority has published the Maharashtra Real Estate Regulatory Authority (General) Regulations, 2017 (the Regulations), which clearly outlines the goals of the Act. While the Act was passed to promote professionalism, responsibility, and competition in the real estate industry. And while real estate brokers, who connect home purchasers, allottees, and promoters, are an integral part of the real estate industry and help to expedite most real estate transactions. In addition, Section 9 of the Act requires all real estate agents to register with MahaRERA before helping to sell or buy a plot, apartment, unit, or building, as the case may be, in a real estate project or a portion of it that is being sold by a promoter. As a result, MahaRERA has about 381 real estate agents registered throughout the State of Maharashtra Real estate agents serve as the public face of the industry and act as a mediator between home buyers and allottees and promoters. And yet, in the State of Maharashtra, it is necessary to establish a system for real estate agents to enrol in formal training and certification programmes. This will allow homebuyers and allottees to receive thorough professional advice and expertise, enabling them to make well-informed decisions about the real estate market. And in view of the need to ensure that real estate agents are professionally qualified to help / assist home buyers / allottees, as well as to improve knowledge and awareness of the regulatory and legal framework and practises, as well as to enforce the code of conduct, MahaRERA proposes to introduce a basic real estate agent training and certification course for real estate agents throughout the State of Maharashtra. And while, over the past two years, MahaRERA has developed the basic curriculum for real estate agent training in consultation with associations of real estate agents, homebuyers, promoters, and All India Institute of Local Self Government (AIILSG), and has appointed training providers for dispensing the training as per the convenience of the real estate agents: online, physical, and in hybrid form with effect from the first week of February 2023. And in order to conduct online exams so that real estate agents who pass the exams are given a "Certificate of Competency," MahaRERA has partnered with the Institute of Banking Personnel Selection (IBPS). Given the foregoing, the following instructions are given:
A) As of 01.05.N23, only real estate agents who possess a current MahaRERA Real Estate Agent Certificate of Competency are eligible to apply for registration or renewal under MahaRERA.
b) All individual real estate agents in the case of people, and authorised signatory in the case of firms, companies, and organisations (Other than Individuals). ii) Real estate agents who deal with homebuyers and allottees to carry out transactions in real estate projects are employees, staff members, or officers by whatever title they may have.
c)Real estate agents who are currently registered must get a MahaRERA Real Estate Agent Certificate of Competency before September 1, 2023, and upload it to their individual website. If they fail to do so, the Authority will take any measures it deems appropriate.
d) Promoters of real estate projects must make sure that, as of September 1, 2023, only real estate agents with MahaRERA Real Estate Agent Certificates of Competency are included in Section 4(2)(j) of the Act together with their names and addresses.
e)Soon, guidelines describing the procedure for real estate agents' certification and training will be released. With immediate effect, this Order will go into effect.
