If you are getting ready to sell your home and you meet with your realtor to sign the listing agreement and your realtor asks you if you are married, they aren’t being nosy - there is actually a good reason for their question.

In Alberta, we have something called the Dower Act, and as antiquated as that may sound, there is actually a good reason for it.

In Alberta, if you are legally married - common law doesn’t apply here - and only one person is on title, the other person has what’s called dower rights to the property. It’s a protection so that the person on title can’t just go and sell they property without the other’s consent.

The person who isn’t on title has to give their consent for both the listing and the sale of the property.
